____ I, ___________(your name)___________the undersigned, in consideration of Talus Rock Retreat LLC, Bruce Pedersen and Heather Mehra-Pedersen and their heirs, successors, its affiliates, officers, directors, agents, friends, family and employees (herein referred to as “TRR”), are providing access to this property for my participation in any of the various activities, work chores, experiences, and programs offered by TRR, the undersigned hereby expressly acknowledges, accepts and assumes all risk of serious personal injury, including death and property damage to equipment associated with said activities or services.

I understand that I am volunteering my time, energy and skills at Talus Rock Retreat and that until an Agreement has been negotiated or signed otherwise, that all time spent exploring opportunities, assessing a live-in situation or any other benefit to Talus Rock Retreat will incur no financial burden to Talus Rock Retreat. This statement remains in effect until a different contractual arrangement stating otherwise has been dated and signed by both parties.
I understand that the nature of the work may or may not be considered dangerous and that I will not hold ANYone responsible for what may or may not happen to me on or off the property while working or volunteering or visiting or daily living onsite at Talus Rock Retreat.
I agree that I am wholly responsible for my own safety, health, and overall life and it is not the responsibility of TRR to recommend, manage, or suggest safety measures but that I work, volunteer and live at my own risk and agree to defend, indem defend, indemnify, and hold harmless the TRR, from any and all liability and claim whatsoever for damages because of bodily injury, death, property damage, sickness, disease or less any expense arising from working, volunteering or living on or off site under this agreement.
I hereby assume all responsibility for any and all risk of property damage or bodily injury that I may sustain while participating in any voluntary relief effort,disaster exercise or other activity of any nature, including the use of equipment and facilities of Talus Rock Retreat LLC
I understand indoor and outdoor work-related or entertainment-related activities such as walking, camping, boating, hiking, biking, scooter/ ATV riding, driving, fishing, swimming, challenge activities, or indoor and outdoor work or volunteer related activities and all other on and off premise activities can be dangerous, and entail inherent, known and unknown risks that could result in physical or emotional injury, paralysis, death, or damage to participants, to property or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity or the business of the Retreat or owners. This includes all other work and non-work related activities including, but not limited to: changing weather conditions, variations or steepness in terrain; snow or ice conditions; surface or subsurface conditions such as forest growth and debris, rocks, stumps; and a person’s failure to perform within his or her own skills and abilities or general natural occurrences whether negligence is present or not by the Owners or other persons related to TRR.
I understand I may be using tools and equipment furnished by TRR. I understand and agree that I will be responsible for the replacement fee of any equipment used and damaged by guests/friends of guests at this event. I further agree to assume all responsibility for the well-being and safety of all guests at this event while they are using any TRR equipment and participating in any of the activities on the TRR property.
I further understand and acknowledge HELMETS AND SAFETY GOGGLES ARE MANDATORY AND REQUIRED for any person participating in potential risk work-related or entertainment-related activities, indoor or outdoor. It is my responsibility to ensure my own safety at all times no matter what I am doing.
In consideration for participation in any of the various activities, work requirements and programs at TRR and the use of TRR facilities, I hereby waive, without limitation, any and all claims for injury, liability or damage against TRR arising out of TRR negligence or the negligence of any of its agents, employees, friends or family members, and hereby RELEASE FROM LIABILITY, INDEMNIFY AND HOLD HARMLESS Talus Rock Retreat DBA Bookpoint, LLC, Bruce Pedersen and Heather Mehra-Pedersen, their heirs and successors, its affiliates, officers, directors, agents, friends, family and employees from any and all liability of damages arising out of my or my family or those for whose participation in these activities I am acting as agent on this document. I agree that any legal action involving interpretation of this document and/or alleging liability against TRR, regardless of the legal theory under which the action is brought, shall only be filed in the State of Idaho and shall be governed by Idaho Law.

I am signing this Liability Release on behalf of the child or children (who is/are minors less than 18 years of age) listed above. I represent I am the parent and/or legal guardian of named child/children and/or have the written permission to act as parent and/or legal guardian on behalf of named child/children taking full responsibility according to the terms of this agreement while they are using any TRR equipment and participating in any of the activities on the TRR property. As the parent or guardian signing this agreement for the child/children, I acknowledge and agree I have read the above entire agreement, and by signing this Agreement on behalf of the child/children, the children and I agree to be bound by its terms. I hereby agree to forever release, discharge, waive, save and hold harmless, indemnify, and defend Releasees from any claims, demands, causes of action, liabilities, actions, and any and all medical expenses or other related expenses, including damage to property, asserted by others, by me and/or the child/children, our estate, executors, heirs, or assignees brought under any theory of legal liability, INCLUDING NEGLIGENCE. I understand that it is my responsibility to fully inform TRR representatives and Bruce Pedersen and Heather Mehra-Pedersen of any special needs the child/children may have. I accept responsibility for all the minor child/children's medical expenses incurred in connection with any activity; I agree to indemnify the Releasees for any and all claims whatsoever brought by the child/children; and I agree to indemnify the Releasees for any and all claims whatsoever brought by a third party arising in connection with the Child/children.
I am signing this Liability Release on my own behalf. I acknowledge and agree I have read the above entire agreement, and by signing this Agreement I agree to be bound by its terms. I hereby agree to forever release, discharge, waive, save and hold harmless, indemnify, and defend Releasees from any claims, demands, causes of action, liabilities, actions, and any and all medical expenses or other related expenses, including damage to property, asserted by others, by me and/or our estate, executors, heirs, or assignees brought under any theory of legal liability, INCLUDING NEGLIGENCE. I understand that it is my responsibility to fully inform TRR representatives and Bruce Pedersen and Heather Mehra-Pedersen of any special needs I may have. I accept responsibility for all my medical expenses incurred in connection with any activity; I agree to indemnify the Releasees for any and all claims whatsoever; and I agree to indemnify the Releasees for any and all claims whatsoever brought by a third party arising in connection with me.
